Greene County Lieutenant Under Disciplinary Review

A Greene County Sheriff's lieutenant is under disciplinary review for not pulling over a suspected drunk driver soon enough. At issue, whether the officer was more focused on getting home than protecting the public.

A viewer called KSPR concerned that Lt. Blaine Kennard put off pulling over a drunk driver because his shift was over.

On Friday May 2nd around 10:40 p.m. Lieutenant Blaine Kennard was driving his patrol car home from a long day of work when he called dispatch. The radio traffic between Kennard and a dispatcher you can hear the lieutenant say, “Do I have any officers in the area.”

Greene County Sheriff Jack Merritt says calling for back up is routine but some question what the lieutenant said next. Over the radio Lt. Kennard says, “I've got a possible 10-55 I'm following. I'm heading to the residence so I'm going to go ahead and follow it." A 10-55 is code for a drunk driver. Kennard decided to follow, waiting for back up rather than pulling the driver over. Sheriff Merritt says, "It's not uncommon to follow to develop your case."

The Recording and report show by the time Kennard called dispatch; he had already seen plenty of proof. Over the radio Lt. Kennard says, “If it gets much worse, I'm going to have to stop." In his report Kennard wrote that a 19-year-old female driver swerved into the median and hit a traffic post the moment he spotted her. He also notes she was weaving in and out of traffic lanes, crossing the fog line, speeding more than 15 miles over the limit and nearly hit a car.

Other deputies ask if they need to hurry over the radio while the lieutenant continues to follow the car until the driver hit another car at a stoplight. The car crash happened 15 city blocks after Lt. Kennard first saw signs of recklessness.

KSPR asked if stopping the driver right away could have prevented the crash down the road. Sheriff Merritt says, “True but if he would have lit up right then how do you know a chase wouldn't have created more danger?" In his report, Kennard says he didn't pull the driver over sooner because of light traffic and the possibility of a chase. Again over the radio Kennard said, "I'm headed to the residence so I'm going to go ahead and follow." Merritt says, "He wanted to get someone on duty to deal with it." Kennard and other officers were now dealing with a wreck and a car leaving the scene of an accident.

The driver eventually stops and is booked for driving with a blood alcohol content of .220 which is more than twice the legal limit. Sheriff Merritt says, "He could have just as easily saw that vehicle and turned the other way." Merritt says his officer did the right thing even though Merritt put Kennard under disciplinary review. Merritt says, "My confidence isn't lessened in him because of this."

Merritt says in a career full of split second decisions it’s normal for someone to second guess your work. A disciplinary review board is taking a second look at Kennard's actions that night. As for what if any punishment, the Sheriff says it's a personnel matter he can't discuss.

Also, why is the discipline of the deputy in the taser case public but not for Blaine Kennard? I wonder if the fired deputy has anything to say about the Lt?

Finally, there may be dash cam video of the final stop made by Lt. Kennard. Most Greene County Sheriff’s Department Dodge Chargers are equipped with dash cams that do not activate until lights and sirens are turned on. Once they are turned on the video rolls back and starts recording. Since Lt. Kennard did not turn on his lights and sirens until after the accident, no video prior to the accident is recorded. Therefore, there is no dash cam video leading up to the accident or the accident itself.

KSPR would like to answer a few questions posted by our viewers. Lieutenant Kennard’s discipline falls under a personnel matter. Therefore it is not an open record. All KSPR can do is confirm that his actions were under disciplinary review. We cannot confirm his punishment. Personnel issues do not meet Sunshine Law requirements. Also, we did not ask Chief Deputy Jim Arnott for an interview on this issue. We asked to interview Sheriff Jack Merritt because he is currently in charge of discipline.

Someone I know who works for the county said the only punishment Lt Kennard got was that he isn't allowed to work security jobs for 6 months. That ain't much, especially when deputy Green was fired for joking around with his tazer.

Courage, I think not, at least not without a uniform. More like a nepoleon complex. He is a police oficer to make up for the way the little guy was picked on as a kid.I cant believe he didnt stop her right away just for the glory. Knowing him, it had to be that he wanted to go home.I think, if you knew his history, you would find that if he didnt resign from a former department he would have been fired. It is a good thing that greene county didnt know about that, or did they?

Come on...did not want to activate his lights because of the possiblity of a car chase. Give me a break! How many times has Greene County chased the wheels off a car for less. It sounds to me like Kennard and Merritt got their stories together to do damage control. This was a perfect opportunity for Greene COUNTY to arrest a DWI driver in the city limits of Springfield, which seems to be the norm. Come on do your JOB!!!!!!

If Kennard was trying to develop this case, as Merritt alleges, why wasn't his dash cam running?Kennard, a supervisor, in a county car, wearing a county uniform exhibited acute laziness! While I can empathize with the "off duty" police officer, he had the absolute duty to stop this obvious drunk driver before she killed someone. And what is the notion of not pursuing a drunk driver because it may cause more harm than good or something along that line. Tell that to the innocent party who WAS hurt because she WASN'T stopped. I have worked with this man for his entire term as sheriff and amazed that anyone could post such vicious and slanderous statements. Kennard, and Green were two of the Sheriffs "golden boys". The diference in discipline is simple one involves a lawsuit. Kennard's sexual harassment is known within the department not in public or it wasn't. The Sheriff takes care of his own this is for sure. Merritt's out of office soon though he's backing yet another of his golden boys for the office. I wonder if this would have even seen light if it wasn't a election year. People need to take a greater interest in that department for sure.

The inconsistent discipline that was referred to is amusing,considering both Green, and Kennard are some of the Sheriff's good ole boys as you probably know being former Greene County. I must say the reasoning behind Green was no doubt due to the lawsuit. We will see how this pans out for Kennard if there is a lawsuit involved. Kennard's history of harassment is well known throughout the department but not known to the public or at least it wasn't. Merritts done after term. Thats his only worry

I believe the Greene County Sheriff's Department's policy requires deputies to record ALL DWI arrests on video. If kennard had a camera and didn't record, he violated policy. Not to mention not attempting to stop a person who was apparently obviously VERY drunk.

It seems like some people want it both ways. If the police had to chase the car and that caused a wreck "we" the public would have been going against the officer. He waits a few blockes, 15 and a wreck happens and the officer is blamed. "we" as citizens need to decide what we want out of our law enforcement. I am sure that the Lieutenant was very tired and didn't want to spend the time writing a report and being in the seen and booking the person.
