Missouri car buyers who believe they've been stuck with a lemon could face new restrictions on who they can sue.
Under the legislation approved today, consumers would be able to sue only the dealership that sold them their vehicle.
The bill is supposed to reverse a Supreme Court decision allowing a lawsuit against a wholesaler who supplied the car to a retail dealership.
“Instead of the new car dealer selling that vehicle directly to a consumer, they sell it to a wholesaler, they sometimes sell it to a different wholesaler. So when it gets to the ultimate consumer the beginning dealership probably has had little or no connection with it,” says Sen. Delbert Scott (R-Lowry City).
The bill only affects lawsuits involving deception, false promises, or misrepresentation.
It now goes to the governor.

I am attorney who handles Texas Lemon Law cases and find that this proposed law limits the consumer's right substantially. The consumer, who is generally a victim to these deceptive conduct, should have the right to pursue their claim against all involved parties, including wholesalers. http://www.texaslemon.com
