Judge Judith C. Ensor rejected the appeal from George Moehrle Masonry Inc., a company based in Frederick, and affirmed the decision of a county hearing officer, who had awarded the company $72,603.
According to a statement from the county, Moehrle had a $3 million contract for work to be performed in 2004 and 2005. Moehrle claimed that delays caused by the county or another contractor held up the job, causing damages and lost of productivity.
In a hearing in 2008, both sides presented expert testimony on their method of calculating damages. The hearing officer accepted the county's approach supporting the much lower figure, denying the lost of productivity claim entirely, the county statement said.
Ensor issued her decision on May 2, and Moehrle has 30 days to file notice that it will challenge the decision before the Maryland Court of Special Appeals.
George Moehrle, the company president, said Monday that he and his lawyer were considering the possibility of appeal.
